Agreement to Terms
By accessing or using the Mulkey Dumpster Rental website (mulkeydumpsterrental.com) or any of our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.
These terms apply to all visitors, customers, contractors, and anyone else who accesses or uses our services.
Services Overview
Mulkey Dumpster Rental provides roll-off dumpster rental services throughout Northwest Georgia. We deliver, place, and pick up 15, 20, and 30 yard roll-off containers for residential, commercial, and construction projects.
Our service area covers Floyd, Bartow, Polk, Gordon, Chattooga, Paulding, and Walker counties, along with surrounding communities. Service availability may vary by location.
Dumpster Rental Terms
Rental Period
All dumpster rentals include up to 14 days from the date of delivery. If you need the container for longer than 14 days, contact us to arrange an extension. Extensions are billed at $7 per additional day.
Delivery and Placement
We will deliver the dumpster to the location you specify during booking. You are responsible for ensuring the placement area is accessible, clear of obstructions, and has adequate space for delivery and pickup.
Our drivers will place the container as close to your preferred location as safely possible. Final placement is at the driver’s discretion based on site conditions, overhead clearances, surface stability, and safe truck access.
Permits
If the dumpster is placed on your own private property (driveway, yard, job site), a permit is typically not required. If the dumpster needs to be placed on a public street, sidewalk, or right-of-way, you are responsible for obtaining any required permits from your local municipality or county before delivery.
Weight Limits
Each dumpster size includes a set weight allowance:
- 15 Yard: 2 tons included
- 20 Yard: 3 tons included
- 30 Yard: 4 tons included
Weight overages are billed at $75 per additional ton beyond your included allowance. Final weight is determined at the disposal facility.
Prohibited Items
The following items are not permitted in our dumpsters:
- Hazardous chemicals, pesticides, herbicides, asbestos
- Wet paint, stains, lacquer, varnish
- Motor oil, gasoline, diesel, kerosene
- Propane tanks, gas cans, flammable liquids
- Medical waste, needles, pharmaceuticals, biohazards
Prohibited Item Fee: If prohibited items are found in your dumpster, additional charges will apply. Fees are assessed on a case-by-case basis depending on what is found and the cost of proper disposal.
Overfilling
Debris must remain level with or below the top of the dumpster walls. We cannot haul overloaded containers. If a dumpster is overfilled, you will be asked to remove excess material before we can pick it up. Overfilling may result in additional charges.
Property Responsibility
Mulkey Dumpster Rental takes reasonable care during delivery and pickup. However, we are not responsible for damage to driveways, landscaping, underground utilities, or other property features caused by the weight of the container or the delivery process. If you have concerns about surface protection, please discuss placement options with us before delivery.
Pricing and Payment
All prices quoted are based on the dumpster size selected, the included rental period, and the included weight allowance. Your quote includes delivery and pickup within our standard service area.
Delivery beyond 20 miles from our base location may incur an additional charge of $7 per mile.
Payment is due at the time of booking or as otherwise agreed upon. We accept major credit cards and other payment methods as indicated during checkout.
Prices are subject to change without notice. The price confirmed at the time of your booking is the price you will pay for that rental.
Cancellation Policy
If you need to cancel your rental, please contact us as soon as possible. Cancellations made before the dumpster has been dispatched for delivery will receive a full refund. Once the dumpster is en route or has been delivered, cancellation fees may apply.
Liability and Indemnification
You agree to indemnify and hold harmless Mulkey Dumpster Rental, its owners, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, including but not limited to property damage, personal injury, or violations of these terms.
Mulkey Dumpster Rental is not liable for any indirect, incidental, special, or consequential damages arising from the use of our services.
Limitation of Liability
Our total liability to you for any claim arising from our services is limited to the amount you paid for the specific rental in question. This limitation applies to all claims, whether based on contract, tort, or any other legal theory.
Website Use
All content on this website, including text, images, graphics, logos, and code, is the property of Mulkey Dumpster Rental and is protected by copyright law. You may not copy, reproduce, distribute, or create derivative works from our content without written permission.
You agree not to use automated tools, bots, or scrapers to access or extract data from our website.
Third-Party Links
Our website may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party sites. Visiting external links is at your own risk.
Dispute Resolution
These terms are governed by the laws of the State of Georgia. Any disputes arising from these terms or our services will be resolved through binding arbitration in Floyd County, Georgia, in accordance with the rules of the American Arbitration Association.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Mulkey Dumpster Rental.
Force Majeure
Mulkey Dumpster Rental is not liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, road closures, government actions, or equipment failures.
Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Changes to These Terms
We may update these Terms and Conditions at any time. When we do, we will revise the “Last Updated” date at the top of this page. Continued use of our website or services after any changes constitutes your acceptance of the updated terms.
